…But Federal and State Rules Might Conflict

By Lisa Cross, Business Editor -- graphic arts online, 9/1/2004

PIA reports that the DOL exempt/non-exempt overtime law may have some conflict with state laws. The association recommends that printers contact their local PIA/GATF affiliate and local legal counsel for help in determining evaluating state requirements.

The original Fair Labor Standards Act, which was enacted more than 50 years ago, has had only minor updates since, even though the today's workplace is vastly different today than in the past.

PIA reports that print employers have been contacting them for an update to the law because the web of old regulations and inconsistent court rulings has resulted in a largely arbitrary compliance framework. In addition, says the group, the regulations were very difficult to understand and apply, leading to a recent explosion of litigation pursued by opportunistic trial lawyers.
